Terms of Service

1. Acceptance of Terms

By accessing or using the MyExclusiveProperty platform at myexclusiveproperty.co.za (the "Platform"), submitting any form, or purchasing any service, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you may not use the Platform.

2. Services Offered

MyExclusiveProperty (Pty) Ltd provides the following services to registered property practitioners:

All prices are in South African Rand (ZAR) and inclusive of VAT where applicable. Prices are subject to change with 30 days' notice.

3. Intellectual Property and Content Submissions

By submitting a listing URL, property description, images, or any other content to the Platform, you represent and warrant that:

• —You are the listing agent for the property and are authorised to submit the listing data.
• —You hold all necessary rights, licences, and consents in respect of any images you upload directly to the Platform.
• —The submission does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.
• —You understand that images scraped from third-party portals (e.g., Property24, Private Property) are used solely for AI copy generation and are not displayed publicly on the Platform.

You grant MyExclusiveProperty (Pty) Ltd a non-exclusive, royalty-free licence to reproduce, publish, and display content you have directly uploaded on the Platform and associated marketing channels for the duration of the service term.

The AI-generated editorial copy, design templates, and all Platform content produced by MyExclusiveProperty remain the intellectual property of MyExclusiveProperty (Pty) Ltd. You are granted a licence to use your individual showcase page and agent profile for personal and professional marketing purposes.

4. PPRA Compliance

By applying for an agent profile, you confirm that you are a registered property practitioner in good standing with the Property Practitioners Regulatory Authority (PPRA) and that the Fidelity Fund Certificate (FFC) number you provide is valid and current. MyExclusiveProperty reserves the right to remove any profile where the FFC number is found to be invalid, expired, or fraudulently provided.

5. Payment and Refunds

All payments are processed via electronic funds transfer (EFT) or a designated payment gateway. Services are activated upon confirmation of payment. Bundle credits (showcase pages) are valid for 12 months from the date of purchase. Unused credits expire after 12 months and are non-refundable. Agent profile pages are active for 12 months from activation. No refunds are issued for partially used services.

6. Limitation of Liability

MyExclusiveProperty (Pty) Ltd provides the Platform on an "as is" basis. We do not warrant that the Platform will be uninterrupted, error-free, or that AI-generated content will be accurate in all respects. We accept no liability for any direct, indirect, incidental, or consequential loss arising from the use of the Platform, including but not limited to reliance on AI-generated property descriptions. Our maximum aggregate liability to any user shall not exceed the total amount paid by that user in the 12 months preceding the claim.

7. Prohibited Conduct

You may not use the Platform to:

• —Submit listings for properties you do not have a mandate to market
• —Upload images you do not own or have a licence to use
• —Provide false or misleading professional information, including a fraudulent FFC number
• —Scrape, copy, or reproduce Platform content for competing services
• —Attempt to circumvent any security or access controls

8. Termination

We reserve the right to suspend or terminate access to the Platform, remove any showcase page or agent profile, and cancel any outstanding service credits, without notice, where we reasonably believe a user has breached these Terms or applicable law. No refund will be issued in cases of termination for cause.

9. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
